Nutzungsbedingungen für Pith

Geltungsbereich
Diese Bedingungen gelten für die Apps „Pith“ für iPhone und Mac von Tibor Czekay (Anbieter, Adresse im Impressum). Beim Laden aus dem App Store gelten zusätzlich die Standard-Lizenzbedingungen von Apple (Licensed Application End User License Agreement). Vertragspartner für den Bezug der App ist Apple, die App selbst stellt der Anbieter bereit.
Was Pith leistet
Pith lässt ein Sprachmodell auf Ihrem Mac laufen und erlaubt Ihnen, es vom iPhone aus zu nutzen. Pith ist kostenlos. Es gibt keine Käufe und keine Werbung.
Ihre Nutzung
- Sie dürfen Pith für private und berufliche Zwecke nutzen, solange Sie dabei Gesetze und Rechte anderer beachten.
- Sie sind für das verantwortlich, was Sie dem Modell schreiben und was Sie mit den Antworten tun.
- Modelle laden die Apps von Hugging Face. Für jedes Modell gilt die Lizenz seines Urhebers. Welche Lizenz ein Modell hat, sehen Sie in der App und unter Lizenzen. Eigene Modelle importieren Sie auf eigene Verantwortung.
- Sie nutzen Pith nur mit Ihrem eigenen Apple-Account und Ihren eigenen Geräten.
Alter
Pith ist nicht für Kinder unter 16 Jahren gedacht. Wenn Sie unter 16 sind, nutzen Sie Pith nur mit Zustimmung Ihrer Eltern.
KI-Ausgaben
Sprachmodelle schreiben Antworten, die flüssig klingen, aber falsch, veraltet, unvollständig oder unpassend sein können. Verlassen Sie sich nicht darauf für medizinische, rechtliche, finanzielle oder sicherheitsrelevante Entscheidungen. Prüfen Sie wichtige Aussagen selbst. Pith filtert Antworten nicht.
Verfügbarkeit
Pith hängt von Ihrem Mac, Ihrem iPhone, iCloud und Ihrem Netzwerk ab. Ein Mac im Ruhezustand kann nicht antworten, und iCloud kann ihn nicht aufwecken. Wie schnell eine Antwort beginnt, hängt von iCloud ab, und Apple nennt dafür keine Zusagen. Ich schulde keine bestimmte Verfügbarkeit und keinen Support.
Haftung
Pith ist kostenlos. Ich hafte deshalb nur für Vorsatz und grobe Fahrlässigkeit, bei Arglist in vollem Umfang. Unberührt bleibt die Haftung für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, nach dem Produkthaftungsgesetz und soweit zwingendes Recht eine weitergehende Haftung vorsieht. Für Inhalte, die ein Modell erzeugt, hafte ich nicht.
Rechte an Pith
Alle Rechte an Pith, an Namen und Symbol liegen bei Tibor Czekay, soweit nicht Rechte Dritter bestehen. Bestandteile von Dritten und ihre Lizenzen stehen unter Lizenzen.
Beenden
Sie können Pith jederzeit löschen. Vorher können Sie in der App „Alle meine Daten löschen“ nutzen. Ich kann die Bereitstellung der App einstellen.
Anwendbares Recht
Es gilt deutsches Recht. Wenn Sie Verbraucher sind, bleiben zwingende Verbraucherschutzvorschriften des Staates unberührt, in dem Sie Ihren gewöhnlichen Aufenthalt haben.
Änderungen
Ich kann diese Bedingungen ändern, wenn es sachlich nötig ist, etwa wegen neuer Funktionen oder geänderter Gesetze. Die aktuelle Fassung steht hier, das Datum oben zeigt den Stand.

Scope
These terms apply to the “Pith” apps for iPhone and Mac by Tibor Czekay (the provider, address in the legal notice). When you get the app from the App Store, Apple's standard terms (Licensed Application End User License Agreement) also apply. Apple is the party you deal with for obtaining the app, and the provider supplies the app itself.
What Pith does
Pith runs a language model on your Mac and lets you use it from your iPhone. Pith is free. There are no purchases and no ads.
Your use
- You may use Pith for private and professional purposes as long as you respect the law and the rights of others.
- You are responsible for what you write to the model and for what you do with its replies.
- The apps download models from Hugging Face. Each model is under its author's licence. You can see a model's licence in the app and under Licences. You import your own models at your own responsibility.
- You use Pith only with your own Apple account and your own devices.
Age
Pith is not meant for children under 16. If you are under 16, use Pith only with the consent of your parents.
AI output
Language models write replies that sound fluent but can be wrong, out of date, incomplete or unsuitable. Do not rely on them for medical, legal, financial or safety decisions. Check important statements yourself. Pith does not filter replies.
Availability
Pith depends on your Mac, your iPhone, iCloud and your network. A sleeping Mac cannot answer, and iCloud cannot wake it. How fast a reply starts depends on iCloud, and Apple gives no commitments for that. I owe no particular availability and no support.
Liability
Pith is free of charge. I am therefore liable only for intent and gross negligence, and in full for fraudulent concealment. Liability for injury to life, body or health, under the Product Liability Act, and where mandatory law provides for wider liability remains unaffected. I am not liable for content a model generates.
Rights in Pith
All rights in Pith, its name and its symbol belong to Tibor Czekay unless third parties hold rights. Third-party components and their licences are listed under Licences.
Ending use
You can delete Pith at any time. Before that you can use “Delete all my data” in the app. I may stop providing the app.
Governing law
German law applies. If you are a consumer, mandatory consumer protection rules of the country where you normally live remain unaffected.
Changes
I may change these terms when there is a good reason, such as new features or changed law. The current version is here, and the date above shows its status.
