Ablauf beim ersten Start
- unrichtige Daten berichtigen lassen (Art. 16 DSGVO),

I have not appointed a data protection officer because there is no legal obligation to do so.
Summary
Bye Asteroid is an arcade game for iPhone and iPad. There is no user account, no chat and no server of mine; your progress stays on your device. The game is free and funded by Google AdMob advertising and optional in-app purchases. Before any advertising starts, the app asks for your decision with Google's consent form. I use no analytics or tracking services of my own. The terms of use also apply.
Data on your device
The app stores progress, scores, medals, the virtual currencies stardust and gems, upgrades, purchases and settings locally on your device. I do not receive this data. You can reset your progress completely in the app under Settings, Reset Progress.
Advertising
Bye Asteroid shows two kinds of ads: rewarded videos that you start yourself to earn an in-game reward, and full-screen ads between runs. Buying "Remove Ads", which is also part of the Starter Pack and the Cosmic Vault, removes the full-screen ads for good; rewarded videos stay available if you want them.
What happens at first launch
In the European Economic Area, the United Kingdom and Switzerland, the app shows Google's consent form (User Messaging Platform) at first launch. Only then does it start Google's advertising software (Google Mobile Ads SDK). Next, iOS asks with the App Tracking Transparency prompt whether the app may use your advertising identifier (IDFA). Google uses the advertising identifier only if you allow it there and have consented in the form. The app stores your decisions on your device so that you are not asked at every launch; this storage is necessary to manage your consent (Section 25 (2) No. 2 TDDDG).
With your consent
If you consent in the form, Google may store and read information on your device, for example identifiers used to cap how often an ad is shown and to measure its performance. Depending on your choices, the ads are personalised, meaning tailored to your presumed interests, or non-personalised. The legal basis is your consent (Section 25 (1) TDDDG, Art. 6 (1) (a) GDPR).
Without your consent
If you decline, Google may serve limited ads. According to Google, these involve no personalisation and use neither identifiers nor your device's local storage. Only the data needed to deliver and display an ad and to prevent fraud is processed, in particular your IP address and technical details such as device type, operating system and language. The legal basis is Art. 6 (1) (f) GDPR; my legitimate interest is funding the free game with non-personalised advertising.
Google as recipient
The ads are provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google processes the data as an independent controller and may transfer it to Google LLC in the USA. Google LLC is certified under the EU-U.S. Data Privacy Framework; the transfer is based on the European Commission's adequacy decision of 10 July 2023 (Art. 45 GDPR). How long Google keeps data is set out in the Google Privacy Policy. Google explains how it uses data from its partners' apps at policies.google.com/technologies/partner-sites.
Measurement by Apple
Whether an ad led to an app install can be measured through SKAdNetwork. Apple designed this method so that it identifies neither you nor your device to me or to the advertising partners.
Changing your decision
You can change your decision at any time: in the European Economic Area, the United Kingdom and Switzerland in the app under Settings, About, Ad Privacy, and for the advertising identifier in the iOS Settings app under Privacy & Security, Tracking.
In-app purchases
Apple alone processes purchases through the App Store. I never see your payment details. The app only receives confirmation from Apple that a purchase is valid and then unlocks the content. One-time purchases can be restored with Restore Purchases on any device signed in to the same Apple Account.
Game Center
The leaderboard uses Apple Game Center. If you are signed in to Game Center, Apple processes your Game Center profile and scores under Apple's terms; other players see your player name and score on the leaderboard. I do not process any data from your Game Center account myself. Game Center is optional and the game works without it.
Notifications
After you claim a daily reward, or when you turn notifications on in the app, iOS asks whether Bye Asteroid may send you notifications. If you allow it, the app schedules reminders on your device: in the evening when your daily streak is about to break, the next morning when the next daily reward is ready, and after three or seven days without playing. These are local notifications; no server is involved and no data is transmitted. You can turn notifications off in the app or in the iOS Settings app at any time.
Sharing
If you share a Score Attack result, the iOS share sheet opens with a short text. You decide where the text goes.
Internet connection
The game works without an internet connection. The app connects to load the consent form and ads, to process purchases with Apple and for Game Center. If you tap a link to my website, it opens in your browser.
App Store
You download the app from Apple's App Store. Apple processes data about the download, purchases and your Apple Account under its own responsibility; the Apple Privacy Policy applies. I never receive payment details. Apple gives me only aggregated sales and download figures that do not identify anyone.
If you have turned on "Share With App Developers" under Settings, Privacy & Security, Analytics & Improvements on your device, Apple also gives me crash reports and usage statistics for the app. Apple passes them on only in a form that does not identify you, and I use them only to find bugs. You can turn the option off there at any time.
Backups
Your device may include the app's data in an iCloud backup or in a backup on your computer. Your device settings decide whether and where that happens; iCloud backups are covered by Apple's Privacy Policy. I have no access to such backups.
Children
Bye Asteroid is rated 4+ and aimed at a general audience. The app has no account and no chat, and I do not knowingly collect data from children.
Deleting data
You reset your progress in the app under Settings, Reset Progress. Deleting the app removes all local data. For data that Google processes for advertising, please contact Google.
Your rights
I receive no personal data from the game myself. Google and Apple answer requests about data they process under their own responsibility.
Where I process personal data about you, you may, subject to the statutory conditions,
- request access to that data (Art. 15 GDPR),
- have inaccurate data corrected (Art. 16 GDPR),
- request erasure of your data (Art. 17 GDPR),
- request restriction of processing (Art. 18 GDPR), and
- receive your data in a common, machine-readable format (Art. 20 GDPR).
An informal message to info@tiborczekay.com or through the contact form is enough.
Withdrawing consent
You may withdraw your consent at any time with effect for the future (Art. 7 (3) GDPR). This does not affect the lawfulness of processing carried out before the withdrawal.
Right to object
Where I process data on the basis of Art. 6 (1) (f) GDPR (legitimate interests), you may object to that processing at any time on grounds relating to your particular situation (Art. 21 GDPR). I will then stop processing the data unless I can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing is needed to establish, exercise or defend legal claims.
Complaint to a supervisory authority
You may lodge a complaint with a data protection supervisory authority, in particular in the member state of your habitual residence, your place of work or the place of the alleged infringement (Art. 77 GDPR).
Automated decisions
I make no automated decisions within the meaning of Art. 22 GDPR. If you have agreed to personalised advertising, Google selects ads on the basis of an interest profile (profiling). This has no legal effect on you and does not similarly significantly affect you.
